SCA to hear arguments on validity of HHPs customary marriage

The Supreme Court of Appeal in Bloemfontein will on Friday hear arguments on whether a valid customary marriage between the late Hip-Hop star Jabulani Tsambo popularly known as HHP and his customary law wife Lerato Sengadi was concluded.

The deceased’s father Robert Tsambo has brought the application against Sengadi.

The feud between HHP’s family and his customary wife Lerato Sengadi rages on as Tsambo senior argues that the customary marriage process was never completed and that  the “handing over” of the bride to the Tsambo family did not happen.

He says this was the most important part in his culture as far as customary law marriage is concerned.

These are the arguments Sengadi won in the South Gauteng High Court in October 2018 before the burial of Jabulani.

She said the families celebrated together during the lobola ceremony. Sengadi also argued that a lawful and binding customary law marriage came into existence between herself and HHP in February 2016,   the day the two families met for lobola.

In October, 2018, Judge Ratha Mokgoatlheng ruled that Sengadi had the right to interdict the funeral, however he said considering that the funeral arrangements had already been made, the funeral must go ahead in the spirit of Ubuntu.

Mokgoatlheng also ruled that Sengadi may attend the funeral if she wished to.

“I think the court can exercise in these curious circumstance the interdict to stop the funeral is denied. Further to this court has an undertaking from the family of the deceased that the applicant, if she so wishes to attend the funeral, is not prevented from doing so.”
