The 14-year-old boy, referred to only as “S” for legal reasons, had challenged his parents’ decision to enrol him in a boarding school in Ghana.
Last year, the boy travelled with his parents to Ghana for what he believed was a family visit. However, once there, he was left behind and placed in a boarding school. His parents said they acted out of concern, fearing he was being pulled into criminal circles in London, a claim the teenager strongly denies.
Although the High Court initially ruled against him, the Court of Appeal has now found that the earlier decision contained several inconsistencies. The country’s most senior family judge has ordered the case to be heard again.
The development brings new attention to how courts navigate complex family disputes involving cultural context, international custody, and the rights of minors.
